The following are examples of some of the forensic assignments our financial experts have undertaken;
Quantification of the past and future care costs in a medical negligence case. Our reports also formed the basis along with other medical experts for the establishment of interim periodic payments. We also provided evidence in relation to the evolution and development of the plaintiff’s care regime at both a logistical and financial level. In November 2015 the plaintiff was awarded €10m in the final settlement by the High Court. The total award including previous periodic payments was €14.1 million, one of the highest payments made in a personal injuries case.
Review of the performance of funds managed by the Accountants Office on behalf of a Ward of Court. The purpose of the report was to establish the administration and management charges, the gains earned on the underlying investments and to calculate the rate of return achieved over the period under review. The real rate of return achieved was calculated to be less than 1%. The expert report and the evidence given in the High Court by our financial expert were integral in assisting the plaintiff’s legal team to successfully argue for interest to be taken as being 1% year on year for the purposes of discounting a lump sum award of €13.5 million.
Review of financial information and provision of evidence in relation to a commercial dispute arising out of an earn-out clause on a company sale. Our financial experts assisted with the preparation of the list of financial information and documentation to be requested under discovery. Our financial experts conducted a full forensic review of the financial information made available and carried out on-site reviews.
Preparation of a loss of earnings report in relation to a personal injuries claim. The report quantified the past loss of earnings and provided an opinion on the future loss of earnings arising from the impairment of the victim’s career progression and consequentially the impact of their earning potential.
